these general terms and conditions of sale apply to all bookings made on the website for a maximum of 4 rooms per booking.
the "Customer" refers to any natural person making a reservation on the website, for private or professional purposes, provided that the activity does not fall within the hotel sector, and that it is not carried out for the purposes of resale or distribution, direct or indirect, of rooms.
the Customer acknowledges having reached the age of legal majority and having the legal capacity to enter into a contract.
the Customer acknowledges that he/she has taken note of all the necessary information on the nature, destination and reservation terms and conditions of the services available on the website. Where applicable, the Customer will have requested the necessary services and received all additional information beforehand in order to make his/her reservation with full knowledge of the facts.
any reservation made via the website implies full acceptance of the GTCS.
Pricing conditions and photos
In accordance with article L 221-28 of the French Consumer Code, the customer has no right of withdrawal for accommodation and catering services.

The prices shown at the time of booking are in euros, inclusive of tax (excluding tourist tax) and correspond to the type of room, the number of people and the date selected. These prices are valid only for the criteria chosen at the time of booking.

VAT is charged at the legal rate in force at the time of booking and may be increased by specific local taxes.

Tourist taxes, when applicable, will be indicated on the invoice issued by the establishment. These taxes are not included in the rates communicated at the time of booking. The amount and terms of these taxes are set independently of the company WESTMINSTER FRANCE MANAGEMENT.

The Client undertakes to pay these various taxes to the Hotel without any dispute.

Foreign currency conversions are provided for information only.

Cancellation, modification and prepayment conditions vary according to the rate chosen and the period of stay, and are clearly specified at the time of booking.

The payment requested from the Customer corresponds to the total amount of the purchase, including all taxes.

The photos on the site are provided for information purposes only and do not constitute a contractual commitment. Every effort is made to ensure that they accurately represent the services offered.

Unless otherwise stated, additional services such as breakfast, food, drinks, minibar, treatments or access to the Spa are not included in the rates displayed.

An invoice will be drawn up by the hotel and given to the Client upon provision of the Services booked at the end of their stay.

A bank card number and expiry date are required as a guarantee.

Cancellation is possible free of charge up to 1 day before the date of arrival, 3pm (local time).

In the event of late cancellation or no-show, the amount corresponding to the first night will be deducted from the credit card provided as a guarantee.

This offer cannot be changed or cancelled.

All bookings must be confirmed by a deposit of 100% of the total cost of the stay. In the event of cancellation, amendment, no-show or early departure, the deposit paid is non-refundable.
Your stay
Check-in: Rooms are available from 3pm on the day of arrival.
check-out: Unless otherwise agreed, rooms must be vacated by 11.30am on the day of departure. In the event of late departure without prior agreement, an additional night may be charged.
in the event of early departure or interruption of the stay, please inform the hotel at least 24 hours in advance, failing which 100% of the total price of the stay may be charged.
in the event of a no-show (absence without prior cancellation), the hotel reserves the right to charge the amount corresponding to the first night to the credit card provided at the time of booking.
the entire establishment is strictly non-smoking.
Payment
Payment is made at the time of booking. Financial transactions carried out on the westminster-nice.com website are made via a secure external payment solution or via a secure payment link sent by email.

Security deposit
On arrival at the hotel, guests will be asked to pay a deposit to cover any additional costs not included in the reservation (minibar, room service, restaurant, spa, damage, etc.).
the amount of the security deposit is temporarily blocked on the bank card presented by the customer in the form of a pre-authorisation. No actual debit is made at this stage, except in the event of any additional charges noted during or after the stay.
this pre-authorisation is automatically lifted once the condition of the room has been checked and there are no additional charges. The time taken to release the funds may vary depending on the banking establishment and does not depend on the hotel.
in the event of damage, shortcomings or unpaid services, all or part of the pre-authorised amount may be deducted by the hotel, after informing the Client.
the Client may be asked to show proof of identity as part of the procedures to prevent credit card fraud.
Liability in the event of theft or damage
In accordance with article 1952 of the French Civil Code, WESTMINSTER FRANCE MANAGEMENT, in its capacity as hotelier, is automatically responsible for objects left in the establishment by its clients.
however, this liability may be limited or excluded in the event of manifest negligence on the part of the client (e.g.: door not locked, valuables left unattended outside the secure safe provided for this purpose), or in the event of force majeure, or if the damage results from the behaviour of an unauthorised third party.
apart from these measures, the hotel declines all responsibility for loss, theft or damage not reported and not deposited in accordance with the conditions laid down.
similarly, in the event of damage to or disappearance of property belonging to the hotel, whether committed intentionally or through negligence, the client may be held responsible and charged for the cost of repair or replacement.
Forgotten or unclaimed items
Any object left behind in the establishment and found after the guest's departure will be kept for a period of 1 year. After this period, and in the absence of a written complaint from the guest, the hotel reserves the right to dispose of it freely.
at the client's request, forgotten items may be returned by post, at the recipient's expense and subject to validation of the shipping arrangements with the hotel.
wESTMINSTER FRANCE MANAGEMENT declines all responsibility in the event of loss, theft or deterioration of items sent by post.
Cancellation policy for wellness treatments
Any modification or cancellation of a treatment must be notified to the hotel at least 24 hours in advance. After this time, or in the event of a no-show, the treatment will be invoiced in full.
Additional services
- Covered car park: Secure parking in a covered car park is available for €36 per day, subject to prior reservation and subject to availability.

Pets: To ensure the hygiene and comfort of all, pets are not permitted in the Spa area.
Legal information - Validity of gift vouchers
The gift vouchers offered for sale are issued by the establishment's operating company.
each voucher is valid for 12 months from the date of purchase, as indicated on the electronic document given to the customer after payment.
at the end of this period, the voucher automatically expires and may not be reimbursed, extended or reactivated, except in the case of an exceptional, written commercial decision by the management.
Conditions of use of gift vouchers
Gift vouchers are subject to the following conditions:

Their use is subject to availability at the hotel, restaurant, bar or Spa concerned, and requires prior reservation.

They are valid only for the services indicated on the voucher, or for their monetary equivalent in the establishment at the time of booking, if this is specified.

Some gift vouchers may be subject to date restrictions, such as public holidays, high season periods or special events, which will be communicated at the time of booking in order to offer alternatives in the event of unavailability.
Non-refundable and non-exchangeable
- Gift vouchers are neither refundable nor exchangeable for cash, even in part.

They cannot be credited or carried forward after their expiry date.

They are strictly personal and may not be transferred to a third party, unless otherwise stated or explicitly agreed by the establishment.
Loss, theft or fraud
In the event of loss, theft or fraudulent use of the gift voucher, no duplicate or refund will be given.

No smoking
In accordance with current regulations and in order to guarantee the safety and comfort of all guests, smoking and vaping are strictly prohibited inside the hotel, including in the rooms and communal areas.
any breach of this prohibition may result in the application of a flat-rate penalty of two hundred euros (€200), invoiced to the Customer by the Hotel. This sum is intended to compensate for the additional costs of cleaning and restoring the premises caused by the breach of this rule.
payment of this penalty does not preclude the Hotel from taking any other legal or administrative action it deems necessary.
Imprévision
These General Terms and Conditions of Sale expressly exclude the legal regime of unforeseeability provided for in Article 1195 of the French Civil Code for all services provided by the Supplier to the Customer. The Supplier and the Customer therefore each waive their right to rely on the provisions of Article 1195 of the French Civil Code and the regime of unforeseeability provided for therein, and undertake to fulfil their obligations even if the contractual balance is upset by circumstances that were unforeseeable when the sale was concluded, even if their performance proves excessively onerous, and to bear all the economic and financial consequences thereof.
Force majeure
The Parties shall not be held liable if the non-performance or delay in the performance of any of their obligations as described herein results from a case of force majeure, within the meaning of article 1218 of the French Civil Code.
Mediation and dispute resolution
These General Terms and Conditions of Sale and the transactions arising from them are governed by and subject to French law.
these General Terms and Conditions of Sale are drawn up in French, and in the event that they are translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute.
all disputes to which the purchase and sale transactions concluded in application of these General Terms and Conditions of Sale may give rise, concerning their validity, interpretation, performance, termination, consequences and consequences, and which cannot be resolved between the service provider and the Customer, shall be submitted to the competent courts under the conditions of common law.
in accordance with Article L.612-1 of the Consumer Code, any consumer has the right to have recourse free of charge to a mediator to resolve a dispute with a professional out of court.
within this framework, WESTMINSTER FRANCE MANAGEMENT undertakes to facilitate access to a mediation system by adhering to the charter of the Mediation of Tourism and Travel (MTV).
after contacting the hotel's sales department and submitting a written complaint, if the response is unsatisfactory or if no response is received within 60 days, the customer may refer the matter to the mediator.

the Customer acknowledges that, prior to making a reservation and concluding the contract, he/she has been provided, in a legible and comprehensible manner, with these General Terms and Conditions of Sale and with all the information listed in article L. 221-5 of the French Consumer Code, and in particular with the following information:

I. - Pre-contractual information
Prior to the conclusion of a contract for the sale of goods or the provision of services, digital content or digital services, the trader shall provide the consumer with the following information in a legible and comprehensible manner:
- The essential characteristics of the good, service, digital service or digital content;
- The price of the good, service, digital service or digital content, pursuant to articles L. 112-1 to L. 112-4 ;
- The date on which, or the period within which, the trader undertakes to deliver the goods or provide the service, digital service or digital content;
- Information relating to the trader's identity, postal, telephone and electronic contact details, cancellation arrangements, dispute resolution methods, other contractual terms and conditions and, where applicable, the costs of using the means of distance communication, the existence of codes of conduct and financial deposits and guarantees;

- Where the right of withdrawal exists, the conditions, time limit and procedures for exercising this right, as well as the standard withdrawal form, the conditions of presentation and particulars of which are laid down by decree in the Conseil d'Etat;
- Where applicable, the fact that the consumer bears the cost of returning the goods in the event of withdrawal and, for distance contracts, the cost of returning the goods where, due to their nature, they cannot normally be returned by post;
- Information on the consumer's obligation to pay a fee when exercising his right to withdraw from a contract for the provision of services, the supply of water, gas or electricity and a subscription to a district heating network, the performance of which he has expressly requested before the end of the withdrawal period; this fee is calculated in accordance with the procedures laid down in Article L. 221-25 ;
- Where the right of withdrawal cannot be exercised pursuant to Article L. 221-28, information to the effect that the consumer does not benefit from this right or, where applicable, the circumstances in which he loses it;
- The application of a personalised price based on automated decision-making, where applicable.
The list and content of this information are specified by decree in the Conseil d'Etat.
In the case of a sale by public auction as defined by the first paragraph of article L. 321-3 of the Commercial Code, the information relating to the identity and postal, telephone and electronic contact details of the professional provided for in 4° of I of this article may be replaced by those of the agent.
II - Additional information
In addition to the information provided for in I, any professional, prior to the conclusion of a contract for the provision of services and, where there is no contract, prior to the performance of the provision of services, shall provide the additional information provided for in article L. 111-2.
In accordance with article 10 of Order no. 2021-1734 of 22 December 2021, these provisions come into force on 28 May 2022.
